Controversial Kenyan and Canadian based lawyer Miguna Miguna has claimed that chief justice Martha Koome and justice Njoki Ndung’u will rule in favor of the Building Bridges Initiative (BBI).
According to Miguna Miguna, he has been reading the body languages of Koome and Ndung’u.
“It’s crystal clear from their body language, facial expressions and questions that both Njoki Ndung’u and @CJMarthaKoome have already made a decision to allow the #BBIFraud meritless appeal. I can’t yet read Mwilu, Lenaola, Ouko, Wanjala and Ibrahim.” Tweeted the lawyer.

The sentiments by Miguna Miguna on Martha Koome and Justice Ndung’u however attracted mixed reactions as below:
“Njoki ndungu could not have asked any other question apart from that touching on the president, have also never seen her rule anything against the president.”
“Did they a point CJ Martha Koome so that they can manipulate and control the judiciary.Why don’t they let the will of people to prevail? Again it is a call to Kenya of sober mind to come out and condemn the impunity in the judiciary.”
“I have alot of respect for the entire bench bt their judgement can surprise us. Nobody shld be allow to be above the law. Law shld not be selective despite position one holds.”
“We expect @CJMarthaKoome to rule that Uhuru Kenyatta has absolute immunity, he can’t be sued even when he leaves office.”

In the meantime, Lawyer Isaac Aluochier who hails from Homabay county was back again at the Supreme court in the ongoing Building Bridges Initiative (BBI) appeal at the supreme court.
Isaac Aluochier stole the show during the BBI appeal at the court of appeal after he lectured president Uhuru Kenyatta like his lastborn child.
Isaac Aluochier expressed his disappointment at the head of state for disrespecting court orders on a number of occasions. Thus, he claimed before the court that Uhuru had annoyed him and it was one of the reasons he was before the court to dismantle the BBI.
On Wednesday, Isaac Aluochier while submitting his submissions at the Supreme court made it clear that the constitution was the supreme document and that not even the judges could use extra constitutional means to defend it.
As a result, he said that president Uhuru Kenyatta is not allowed to use state machinery to purport to change the constitution.
At the same time, Isaac Aluochier also weighed in on the presidential immunity and according to him, the head of state can be sued in his capacity as the president if he performs duties that are not within his roles as specified in the constitution
