Emurua Dikirr MP Johana Ng’eno set to be charged with hate speech- DPP

The Director of Public Prosecutions (DPP) Noordin Haji has approved the apprehension and prosecution of Emurua Dikirr Member of Parliament Johana Ng’eno.

In a statement, the DPP highlighted that Ng’eno would be charged with Hate Speech contrary to Section 13 of the National Cohesion and Integration Act, 2008, and offensive conduct conducive to breaches of peace contrary to Section 94 of the Penal Code.

“On Saturday, 5 September 2020 at Emurua Dikirr Constituency, Narok County, the MP uttered words which were threatening, abusive and insulting words intended or were likely to stir up ethnic animosity amongst communities living within Trans Mara area,” the statement read.

“The conduct of the MP was offensive and was intended and/or was likely to provoke a breach of peace within Trans Mara area,”

“I am satisfied there is sufficient evidence to initiate the prosecution of the MP under the National Cohesion and Integration Act, 2008 and the Penal Code, Cap 63, Laws of Kenya.

Additionally, it is in the public interest to prefer criminal charges against the suspect as his actions may open old wounds and incite the different communities in the area against each other owing to the fact that Mau Forest has been an area of contention,” the statement went on.

“I have directed that criminal charges be preferred against the MP for hate speech contrary tp section 13 of the National Cohesion and Integration Act 2008 and offensive conduct conducive to breaches of peace contrary to section 94 of the penal code,” the statement reads further.

The MP was arrested on Monday evening at his home in Narok that saw hundreds of his supporters trooping to the Emurua Dikirr police station in protests.
